Bill C - 45 (Federal)
This Bill does establish corporate criminal liability for all organizations across Canada for workplace health and safety.
This Bill intends to hold employers accountable for safe work environments if they fail to take reasonable steps to prevent workplace accidents that affect workers or the public in general. If it is determined that this duty is recklessly or wantonly disregarded and bodily harm or death results the organization could be charged with criminal negligence.
The proposed changes create additional legal liability for directors, officers and corporate decision makers, as well as all persons directing work in the workplace. This means that everyone who undertakes, or has authority to direct how another person does their work or performs a task, must take reasonable steps to prevent bodily harm to that person, or any person arising from that work or task. This can include foreman, lead hands and co-workers as well as executives and directors of the company.
This Bill establishes for the first time a Criminal code duty for all the above parties.
This Bill has now become law.
